These Terms & Conditions (the “Terms”) govern the relationship between Van Riemsdijk & Karman SL (“we”, “our” or “the Company”), trading as Van Riemsdijk & Karman | Real Estate Media and Koert Van Riemsdijk Photography(individually and collectively the “Brands”), and you, the client (“you”), in connection with the provision of our photography and media services.
By commissioning us – whether for real-estate media, portraits, head-shots, commercial assignments or any other service we offer – you accept and agree to be bound by these Terms.
1. Services
1.1 We offer two principal service categories:
Real-Estate Media – photography, videography, drone imagery, floor plans, virtual tours and related services for marketing real-estate listings.
General Photography – portrait, head-shot, event, editorial and commercial photography provided under the brand Koert Van Riemsdijk Photography.
1.2 Service details, deliverables and prices for each assignment are set out in our proposal, order confirmation or on our website. Any extras requested after confirmation will be quoted and invoiced separately.
2. Booking, Orders & Delivery
2.1 Booking. Orders may be placed via our website, e-mail, phone or in person. A booking is considered firm once we have confirmed the date/time and you have accepted our quotation.
2.2 Turn-around. Unless agreed otherwise in writing:
Real-estate packages: delivery within 3 working days after the shoot.
General photography: online proof gallery within 5 working days; final retouched files within 7 working daysafter your selection.
2.3 Delivery method. Digital files are supplied via password-protected download link or any other method agreed in advance. Physical media (USB, prints, albums) incur shipping costs which will be quoted separately.
3. Pricing & Payment
3.1 All prices are quoted in euros (€) and exclusive of VAT unless stated otherwise.
3.2 Deposits. We may require a non-refundable booking fee of up to 30 % to secure the date. The balance is due on delivery of the final files, unless alternative milestones are stated in the quotation.
3.3 Payment methods. Bank transfer, credit/debit card, Bizum or any method we mutually agree.
3.4 Late payment. Late invoices accrue interest at the statutory rate under Spanish Law 3/2004 plus recovery costs. We reserve the right to suspend licences until payment is received.
4. Cancellation & Rescheduling
4.1 You may cancel or reschedule free of charge up to 48 hours before the agreed start time. Later cancellations incur the following fees:
24–48 h: 50 % of the quoted fee.
< 24 h or no-show: 100 % of the quoted fee.
4.2 Weather. Outdoor sessions affected by adverse weather (rain, strong wind, heavy cloud) will be rescheduled once at no extra cost. Further reschedules may incur a fee.
5. Client Responsibilities
5.1 Access & preparation. You must ensure timely access to the location and that the scene is photo-ready (clean, staged, free of persons not to be photographed). We are not responsible for tidying or staging unless expressly agreed.
5.2 Permissions. You warrant that all necessary permissions (location, model, property, drone flight) are in place and that shooting at the location does not infringe any third-party rights.
6. Intellectual Property & Usage Licence
6.1 Ownership. All photographs, video and other media remain the exclusive property of the Company and are protected by Spanish copyright law (Royal Legislative Decree 1/1996).
6.2 Licence – Real-Estate Media. Upon full payment, we grant you a non-exclusive, non-transferable licence to use the media solely for marketing the specified property for the duration of its listing. Further use (e.g. by architects, builders, interior designers, portals or for multiple listings) requires our written consent and may attract a supplementary fee.
6.3 Licence – General Photography. Upon full payment, we grant:
Personal clients (e.g. portraits/head-shots): a perpetual, worldwide, non-exclusive licence for personal and internal business use, excluding resale or third-party commercial use.
Commercial clients: usage as set out in the quotation (typically 12 months, Spain + online). Extended territories/durations require an additional fee.
6.4 Prohibited uses. You may not alter, sell, give away or sublicense the media without our written permission, save for basic cropping/resizing for the licenced purpose.
6.5 Company portfolio rights. Unless you expressly opt out in writing before the shoot, you grant us the right to display the media in our portfolio, website, social media and awards submissions.
7. Model & Property Releases
Where required, you will obtain signed releases from identifiable persons and property owners. We can provide template forms on request.
8. Liability & Indemnity
8.1 Our liability for any claim arising from the services is limited to the amount you paid for that assignment.
8.2 We are not liable for indirect or consequential losses, loss of profit, or loss of business opportunity.
8.3 You agree to indemnify us against any claims arising from your breach of these Terms, including the warranties in clause 5.2.
8.4 Force majeure. Neither party is liable for failure or delay caused by events beyond reasonable control (e.g. natural disasters, illness, strikes, governmental action).
9. Privacy & Data Protection
We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018. Our full Privacy Policy is available on request or via our website.
10. Governing Law & Jurisdiction
These Terms are governed by Spanish law. Any dispute will be submitted to the courts of Dénia (Alicante) or the court of your residence within the EU, at your option.
11. Amendments
We may revise these Terms at any time. The revised Terms apply to bookings made after the publication date. The current version is always available on our website.
